1.1 The myva.hr website, including all the web products displayed under the myva.hr domain, are owned and operated My Vacation j.d.o.o. (hereinafter “MYVA”), a limited liability company registered in Croatia under company identification number (OIB) 37301988459, with registered offices at Motovunska Ulica 1, 52470 Umag, Croatia.
1.2 MYVA operates the myva.hr online marketplace where customers can purchase goods and services provided by third-party sellers.
1.4 MYVA sells goods and services on behalf of bars, restaurants, wineries, beauty and hair salons, baby sitters, taxi and transport companies, personal service companies, property managers, travel agents, tour operators, car, bike and boat rental companies, sport clubs, local tourist boards, and other persons involved in the destination management industry. Please note that MYVA is not responsible for the production or delivery of the goods and services themselves.
1.5 Nothing in this Purchase Policy, or our Return and Replacement Policy, affects your legal rights as a consumer.
2. YOUR ACCOUNT AND REGISTRATION
2.1 In order to set up a MYVA account to purchase goods and services you must be at least 18 years old.
2.3 MYVA reserves the right to discontinue your account and/or cancel any of your orders if:
(a) you behave in a in an abusive manner via your account;
(b) we detect any fraudulent or otherwise illegal activity on your account;
(c) you violate the terms of this Purchase Policy.
2.4 Termination of your account and/or cancellations of any purchases under this Purchase Policy shall not affect your rights and liabilities that have originated prior to the date of such termination or cancellation.
3. LEGALLY BINDING CONTRACT
3.1 In order to make a purchase from the MYVA Website, you must be at least 18 years old and able to enter into legally binding contracts. Further, you must a valid credit or debit card issued in your name.
3.2 Any purchase on the MYVA website forms a legally binding contract that is subject to: (a) this Purchase Policy; (b) any special terms and conditions specified by the seller/provider of goods/services. We encourage you to read this Purchase Policy carefully before making a purchase.
3.3 By purchasing goods and/or services on the MYVA website, you acknowledge that you have read, understood and agreed to the terms and conditions of this Purchase Policy.
3.4 MYVA reserves the right to make periodical changes to this Purchase Policy. Any such changes shall be made known in the updated version of this Purchase Policy, and published on our website. All purchases are subject to the applicable version of this Purchase Policy that was published at the time of purchase.
4. PRICES, PAYMENT AND PLACING ORDERS
4.1 All prices of goods and services offered for sale on our website are inclusive of VAT and are broken down as follows:
(a) sale price of the goods and/or service; plus
(b) processing charges; plus
(c) handling and/or delivery fees.
4.2 Whereas MYVA makes every effort to keep the prices of its offered goods and services current, errors may occur. If an order is placed for an item that is later found to have a price that is incorrect, customers will be informed as soon as the error is discovered. Customers will then be given the option of confirming the order at the correct price, and the card used to make the purchase will be debited or credited accordingly. In the alternative, customers will be able to cancel the order and receive a full refund.
4.3 All prices are displayed in Croatian Kuna (HRK). MYVA cannot be liable for additional charges customers may incur by their credit or debit card providers, or any currency exchange rate fluctuations, which are entirely at the customer’s risk.
4.4 Accepted methods of payment include Visa, Diners, MasterCard and American Express debit or credit cards.
4.5 The contract for purchase becomes effective once your order has been confirmed by the payment provider, and ends immediately after the delivery of the good(s) and/or completion of the purchased service.
4.6 If you do not receive an order confirmation after submitting payment information, or if you experience a service interruption after submitting payment information, it is your responsibility to confirm whether or not your order has been placed. Only you may be aware of any problems that may occur during the purchase process. We will not be responsible for any costs or losses you incur if you assume that an order was or was not placed because you failed to receive an order confirmation.
4.7 All purchases are subject to credit or debit card verification, other security checks, and collection of payment by MYVA. Your order may be cancelled if it has not passed our verification process or if payment is not received in full.
4.8 Please ensure that you read the entire description details of the item or service you wish to purchase. In particular, please ensure that you are satisfied with your selection prior to confirming your purchase, as we may be unable to rectify issues arising as a result of your mistake.
5. DELIVERY OF GOODS AND PROVISION OF SERVICES
6.1 MYVA aims to deliver the ordered goods and provide the purchased services as soon as possible. As the arrangements for delivery depend on several factors, including third-party providers, MYVA cannot guarantee delivery shall take place at the exact specified time, nor can we assume the risk of any damages or liability that may incur as a result of late delivery.
6.2 Customers are responsible for providing a safe and secure delivery address, except for cases where delivery has been pre-set on the MYVA website or any of its subsidiary web pages. For some deliveries, a signature may be required.
6.3 MYVA is not liable for, and customers shall not be entitled to any refund where delivery is refused, returned, missed, unclaimed or fails as a result of the customer’s failure to provide correct and complete delivery information and/or failure to ensure he or she is available to receive the delivered goods or provided services.
6.4 It is the customer’s responsibility to check the goods immediately once they have been delivered. You should contact us immediately if there is an error with your delivered items, or if they do not match the order as described in your order confirmation.
6.5 MYVA is an intermediary. Products and/or services sold on our platform are produced and/or performed by the relevant producers and/or service providers, who are solely responsible for the quality, safety, accuracy and timely delivery of such products and/or services. We accept no responsibility or liability for the delivery or quality of any such products and/or services. 18. FINAL PROVISIONS
18.1 If any provision of this Purchase Policy is found by a competent court to be invalid or unenforceable, that provision shall be deemed to be omitted from this Purchase Policy. Such omission shall not prevent the other provisions of this Purchase Policy from continuing to remain in full force and operate independently.
18.2 If any provision of this Purchase Policy is or becomes illegal, invalid or unenforceable pursuant to the law of any applicable jurisdiction, this shall not affect or impair the legality, validity or enforceability in that jurisdiction of any other provision of this Purchase Policy.
18.3 Any notice provided under this Purchase Policy shall be delivered upon receipt and shall be deemed to have been received at the time of delivery (if delivered by hand, registered post or courier) or at the time of transmission (if delivered by email).
18.4 This Purchase Policy shall be governed by and construed in all respects in accordance with Croatian law, and both you and we agree to submit to the non-exclusive jurisdiction of the Croatian courts in relation to any dispute arising out of or in connection with this Purchase Policy.
